Équnité Terms of Use (CGU)

Effective date: 22 May 2025

1. Introduction

These Terms of Use ("Terms") establish the conditions governing your use of the Équnité Platform ("Platform"), operated by PLANIPIX. Équnité aims to foster community-driven knowledge, transparency, and fair practices within the volleyball ecosystem through open collaboration and shared resources.

By accessing or registering on the Platform, you accept these Terms without reservation. They apply to all users, including individuals (players, fans, parents or representatives) and legal entities (companies, clubs, partners).

3. Purpose and Scope

The Platform facilitates:

- Public forums for discussion.
- Publication of reviews, testimonials, and articles.
- Access to community-generated content and tools.

These Terms govern:

- User accounts and registrations.
- Content contribution and usage rights.
- Moderation standards and conduct rules.
- Data privacy and user protections.

4. Registration and User Eligibility

Registration is open to:

- Individuals (players, fans, or their legal guardians).
- Legal entities (partners, organizations).

Accounts for minors under 15 must be created and supervised by a parent or legal guardian. Users must provide accurate information and maintain account security. Any misuse of account credentials remains the user's responsibility.

5. Contribution License

All content contributed to Équnité (texts, images, reviews, and other materials) is subject to the Équnité Contribution License, which includes:

- Licensing under CC BY-NC-SA 4.0 (Creative Commons Attribution-NonCommercial-ShareAlike 4.0 International).
- Contributors retaining moral rights.
- Explicit prohibition of commercial exploitation by third parties.
- PLANIPIX's right to utilize content to benefit the community.

Acceptance of these Terms constitutes explicit acceptance of the Contribution License.

6. Content Contribution and Rules

Users may publish:

- Club reviews and personal testimonials.
- Informational articles, advice, or related volleyball resources.
- Contributions to public and restricted discussions.

Users must ensure contributions:

- Are accurate, respectful, lawful, and based on genuine personal experience.
- Do not include defamatory, offensive, false, misleading, or otherwise unlawful material.

PLANIPIX reserves the right to moderate, edit, or remove any content violating these standards without prior notice.

7. Restricted Content and Enforcement

Certain Platform areas (e.g., sensitive reviews, internal reporting tools, verified-user discussions) are restricted to authorized users only.

Any unauthorized access, including access gained through impersonation, coercion, or technical circumvention, constitutes a serious breach of these Terms, punishable by:

- Immediate and permanent suspension of user accounts.
- Potential public disclosure of misconduct to safeguard community integrity.
- Contractual disqualification of legal action based on illegitimately accessed content.

Users agree explicitly that any litigation initiated based on content accessed illicitly will be considered invalid under these Terms, subject to enforcement according to Articles 1103 and following of the French Civil Code.

8. Moderation and Integrity

PLANIPIX reserves full moderation rights, including but not limited to:

- Editing or removing inappropriate or unlawful content.
- Suspending or permanently banning users for violations.
- Ensuring overall platform safety, integrity, and legal compliance.

Persistent violations may lead to permanent account exclusion without recourse.

9. Privacy, Personal Data, and Third-Party Tools

PLANIPIX complies strictly with GDPR (EU Regulation 2016/679) and applicable French data protection laws (Loi Informatique et Libertés amended).

Regarding user account data (registration information, personal details):

- Data is never sold or transferred to third parties for their independent use.
- Data is securely stored and processed solely for internal operations, moderation, and platform security.
- Users retain the right to access, rectify, and request deletion of personal data at any time.

To enhance user experience, performance, and operational efficiency, PLANIPIX utilizes various third-party services and technologies, including but not limited to:

- Analytics Tools: (e.g., Matomo, Google Analytics, Microsoft Clarity) for audience measurement, traffic analysis, and site optimization.
- Artificial Intelligence (AI) and Translation Tools: Including OpenAI API (ChatGPT), Azure Cognitive Services, automated translation engines (LibreTranslate), used for content enhancement, moderation support, multilingual communication, and user assistance.
- Digital Marketing and Retargeting: Social media marketing (SMM), Google Ads, Facebook Ads, retargeting pixels, email marketing platforms, and related advertising techniques.

The use of these third-party technologies involves collecting and processing cookies, device identifiers, IP addresses, and user interaction data. These processes and user consent mechanisms are described comprehensively in our [Privacy Policy](link).

By using the Équnité platform, you acknowledge and consent to the collection and processing of data as detailed in the Privacy Policy.

10. Account Termination and Content

Users can request account deletion at any time by contacting PLANIPIX:

- User-contributed content already published remains available, in line with the CC BY-NC-SA 4.0 license.
- Users may request editing or anonymization of sensitive reviews or personal information upon legitimate justification.

PLANIPIX retains full discretion in handling such requests to balance transparency and user privacy.

11. Donations and Commercial Use

Équnité accepts voluntary donations through PLANIPIX, processed as commercial revenue. Users acknowledge explicitly that:

- Donations create no contractual obligation, guarantee, or influence on platform governance or service provision.
- PLANIPIX may allocate donations toward operational costs, contributor remuneration, platform improvements, and promotional activities.
- Commercial exploitation of platform content by third parties remains strictly forbidden.

12. Changes and Updates

PLANIPIX may amend these Terms periodically due to legal, technical, or operational developments. Changes will be clearly communicated via the platform. Continued use of Équnité following updates implies full acceptance of modified Terms.

13. Liability Limitations

PLANIPIX provides the Platform and content “as-is” and bears no liability regarding accuracy, completeness, or legality of user-generated content. PLANIPIX shall not be liable for any indirect damages arising from Platform usage.

Users explicitly acknowledge responsibility for content they share or publish. PLANIPIX undertakes reasonable efforts to moderate content but cannot guarantee exhaustive moderation.

14. Applicable Law and Jurisdiction

These Terms are exclusively governed by French law.

Any disputes not amicably resolved shall be submitted exclusively to the competent courts of Metz, France.
